المرصد الجنوبي لحقوق الإنسان يلفت نظر مفوضية الأمم المتحدة العليا لحقوق الإنسان وغيرها من المنظمات الدولية إلى إن ما يتعرض له السجين أحمد عمر العبادي المرقشي من انتهاك لحقوقه القانونية, ومن معاملة تخلوا من أبسط الإخلاقيات الإنسانية. وهو مثال صارخ لما يمارس بحق المواطن الجنوبي من حرمان لحقوقه العامة . فالمواطن الجنوبي وإن تم سجنه فإنه ينحرم أيضا من حقوقه كسجين إن لم يكن معتقل سياسي.
هذا ما يحدث للسجين أحمد عمر العبادي المرقشي القابع منذ أربعة أعوام في السجن المركزي لمدينة صنعاء بعد أن حكم عليه بـ " الإعدام " بتهمة كيدية لم يخلوا سير إجراءاتها من خروقات قانونية بينة ، أهمها عدم وجود الدليل القطعي على ثبوت تلك التهمة الكيدية .. ولذلك فإن السجين العبادي يكابد في سجنه شتى أنواع القهر والمعاناة ، علاوة على معاناته من أوجاع والآم ناتجة عن عدد من الأمراض المزمنة التي تتطلب الرعاية والمراقبة المستمرة . ورغما عن ذلك فإن سلطات السجن تحرمه في كثير من الأوقات حق المعاينة الطبية ، حتى جاء موعد إسعاف اضطراري لينقل بتاريخ 15 مايو إلى مستوصف صحي خاص ، عاد منه وهو في حالة أسوء من ما كان عليه من قبل ، بل انه بحسب قول أسرته لم يتمكن من التعرف عليهم ولم يعد قادرا على الكلام ولا على الحركة.
لقد أعربت رسالة أسرة السجين العبادي الموجهة للمرصد الجنوبي لحقوق الإنسان وغيره من المنظمات الإنسانية عن القلق الشديد من جراء تدهور صحة عائلهم وخشيتهم من استهداف حياته تحت مبرر علاجه ، وما يعزز ذلك هو التعامل الذي لمسوه من جنود الحراسة حين أعادوه من المستوصف الخاص مرميا بصورة مهينه في مؤخرة عربة شحن وهو مكبل بالقيود الحديدية ، و كذا من الطريقة الغليظة لتعامل مدير السجن مع أقاربه عندما أمر الجنود بطردهم وعدم السماح لهم بالمكوث معه لموا زرته والاطمئنان عليه.
إن المرصد الجنوبي لحقوق الإنسان يرى في تلك الممارسات انتهاك فظ في حقوق السجين أحمد عمر العبادي المرقشي ، وفي الوقت نفسه يحمل السلطات اليمنية مسؤولية ما يمكن أن تتعرض له حياته من خطر جراء تلك المعاملات الغير قانونية ، مذكرا إياها بالتزاماتها الدولية تجاه المبادئ الأساسية لمعاملة السجناء المعتمدة من قبل الجمعية العامة للأمم المتحدة في ديسمبر عام 1990م وتطبيق المادة " 22 " منها القاضية بحماية السجناء ومعالجتهم ومراعاة حالتهم الصحية.
ويدعوا المرصد الجنوبي لحقوق الإنسان مفوضية الأمم المتحدة لحقوق الإنسان وغيرها من المنظمات الدولية الإنسانية إلى التضامن مع السجين العبادي المرقشي ، والضغط على الحكومة اليمنية لإلغاء محكوميته كونها اتخذت بطريقة تتعارض مع المبادئ الأساسية المعتمدة من قبل الأمم المتحدة لضمان محاكمة عادلة. كما ندعوها إلى التدخل لإطلاق سراحه كون تهمته الكيدية مبنية على خلفية سياسية.

Urgent appeal to save the life of the prisoner Ahmed Omar Alabadi
Southern Observatory for Human Rights draws attention to the High Commissioner for Human Rights in the United Nations, and other international organizations to the suffering of the prisoner Ahmed Omar Alabadi Almarkashi from the violation of his legal rights, and from mistreatment, which devoid from the most basic ethics of humanity. This is a stark example of what practiced against the rights of the citizens in South Yemen, which they are deprived their public rights.



This is what happens to the prisoner, Alabadi, which is residing for four years in the central prison of the city of Sana'a after being sentenced to a "penalty" in a charge, which did not vacate from the vexatious and legal proceedings, and without evidence of violations, such as lack of conclusive evidence to prove that charge malicious. Therefore, the prisoner suffers in his prison various kinds of oppression and suffering, in addition to suffering from aches and pains caused by a number of chronic diseases that require care and ongoing monitoring. Nevertheless, the authorities of the prison prohibited many times the right to medical examination, until the time comes for ambulance emergency landing to convey on 15 May 2012 to private health clinic, and he returned from it in a worse situation than what it was before, and according to the words of his family he was not able to identify his family and not able to speak nor move.



The prisoner's family Alabadi have expressed in the letter directed to the Southern Observatory for Human Rights and other humanitarian organizations for serious concern due to the deteriorating health of breadwinner and the fear targeting his life under the pre**** of treatment, and boost from the dealing which touched soldiers guard when they brought him back from the clinic degrading in the back of a freight wagon with iron shackles, as well as the heavy-handed and deal of the director of the prison with his relatives when he ordered the soldiers to drove their father Alabadi away and not allow them to stay with or visit him.



The Southern Observatory for Human Rights believes in such practices violate rude in the rights of the prisoner Ahmed Alabadi at the same time holds the Yemeni authorities responsible for what may be exposed to his life at risk as a result of illegal transactions, which is reminding it of its international obligations towards the Basic Principles for the Treatment of Prisoners adopted by the General Assembly of the United Nations in December 1990 and the application of Article "22" including the protection of the judge and treatment of prisoners and taking into account their health status.


Southern Observatory for Human Rights calls the High Commissioner for Human Rights in the United Nations and other international humanitarian organizations for solidarity with the prisoner Alabadi, and to pressure on the Yemeni government to cancel his sentence being taken in a manner inconsistent with the basic principles adopted by the United Nations to ensure a fair trial. We also invite them to intervene for his release that his charge malicious based on political grounds.
